General Terms and Conditions of Sale – Verde d’Arno
Art. 1 – General Provisions

These General Terms and Conditions of Sale apply exclusively to the sale of products under the Verde d’Arno brand carried out through the website www.verdearno.com
 (hereinafter, the “Website”), in accordance with the provisions of the Italian Civil Code, Legislative Decree No. 70/2003 (Information Society Services and E-commerce), and the Italian Consumer Code – Legislative Decree No. 206/2005, as amended.

By browsing the Website and placing an order, the user accepts these General Terms and Conditions of Sale and the Privacy Policy available on the Website, which the user is invited to read and store.

Verde d’Arno reserves the right to amend these Terms at any time. Any changes shall apply only to sales concluded after their publication on the Website.

The Website is available in Italian and, where applicable, in English and German. In case of discrepancies, the Italian version shall prevail.

Art. 2 – Subject Matter

These Terms govern the sale of Verde d’Arno products as described in the relevant product pages on the Website.
They do not regulate services or sales provided by third parties that may be referenced through links, banners, or other hyperlinks, for which Verde d’Arno assumes no responsibility.

Art. 3 – Conclusion of the Contract

To make a purchase, the user selects the products, adds them to the shopping cart, and completes the checkout process by entering the required information for the order, delivery, and invoicing, and by selecting the shipping method and payment method among those available.

Before submitting the order, the user acknowledges that clicking the “Confirm Order” button entails an obligation to pay.

After submission, the user completes the payment according to the chosen method; in the case of bank transfer, the order shall remain pending until the payment is received.

Upon receipt of payment (or payment instruction, in the case of bank transfer), Verde d’Arno shall send an order confirmation to the e-mail address provided by the user, containing a summary of the products, prices (VAT included), shipping costs, payment and delivery methods, as well as a reference to these Terms and instructions regarding withdrawal and returns.

Art. 5 – Product Availability

Product availability shown on the Website refers to actual availability at the time the order is placed.

In the event of total or partial unavailability, Verde d’Arno shall promptly inform the user, who may choose to replace the product, wait for restocking, modify, or cancel the order.

Any refund, whether total or partial, shall be made within 14 days of notification, using the same payment method used by the user, unless otherwise agreed.

Art. 6 – Prices and Payments

Product prices are expressed in Euros and include VAT.

Accepted payment methods:

PayPal or Credit Card: processed directly through the PayPal platform. Verde d’Arno does not collect or store payment data.

Advance Bank Transfer: the order will be processed only after receipt of payment. Payment must be made within 3 days of placing the order, failing which the order will be cancelled.

Prices may change at any time but shall not affect orders already confirmed.

Art. 7 – Shipping Methods

We ship our products with care, because every bottle deserves to arrive intact and on time.
We rely on Mail Boxes Etc., a reliable logistics partner that selects the most suitable courier based on destination and order type.

Standard Shipping in Italy

Cost: calculated at checkout based on weight and destination

Estimated delivery time: 2–4 working days (excluding islands and remote areas)

International Shipping

We ship throughout Europe and to many non-EU countries.
Shipping rates and delivery times are calculated automatically at checkout.

Any customs duties, local taxes, or import charges are borne by the Customer and are not included at checkout.

Tracking

Once the order is handed over to the courier, the Customer will receive an e-mail with a tracking link to monitor the shipment at any time.

Anti-breakage Packaging

We use certified and tested packaging materials specifically designed for shipping glass bottles, ensuring maximum protection and sustainability.

Damaged Packaging

If the Customer notices external damage to the packaging, they may proceed as follows:

If the damage appears superficial, the Customer may accept the delivery with reservation, noting the reservation on the delivery document.

If the damage appears to compromise the goods, the Customer may refuse the entire delivery, indicating the reason on the delivery document.

In the event of damaged goods, the Customer must promptly notify Verde d’Arno by e-mail at l.cianfanelli@verdearno.it
, and a replacement or reshipment will be arranged.

Damaged or Non-Conforming Products

In the event of damaged or non-conforming products, the Customer must contact Verde d’Arno within 24 hours of delivery, providing photographs and relevant details.

Failed Delivery, Incorrect Address, Storage

If delivery fails due to the Customer’s absence or incorrect/incomplete shipping details, the courier will attempt a second delivery. If unsuccessful, the order will be placed in storage or returned to the sender.

Any storage, redelivery, or return costs charged by the courier shall be borne by the Customer where the failed delivery is attributable to the Customer (e.g. repeated absence, incorrect or incomplete address, failure to respond to courier communications).

The Customer may request a new delivery by contacting the courier directly or by requesting a new shipment from Verde d’Arno, subject to payment of the relevant costs.

If the parcel is returned to the sender and the Customer exercises the right of withdrawal within the statutory timeframe, the refund shall be made net of the original shipping costs and the actual return costs incurred.

The Customer is responsible for ensuring the accuracy and completeness of delivery details. Delays, storage, or additional costs arising from incorrect or unattended addresses shall be borne by the Customer.

To facilitate delivery, the Customer must provide a valid mobile phone number and an active e-mail address for shipment notifications.

Art. 8 – Shipping Costs

Minimum order: 1 parcel containing 2 bottles (or multiples of 2).
It is not possible to mix different product combinations within a single parcel.

The threshold for free shipping and applicable shipping costs are indicated on the Website and in the order summary before purchase.

Art. 9 – Transfer of Risk and Limitation of Liability

Consumers: risk passes upon delivery to the Customer or a third party designated by the Customer. Ownership transfers upon full payment.

Professionals: risk passes upon delivery to the carrier.

Limitation of Liability
Verde d’Arno shall not be liable for delays or failure to deliver due to force majeure, extraordinary events (such as strikes, natural disasters, customs blocks), or errors attributable to the Customer.

In no event shall Verde d’Arno be liable for indirect, consequential, or loss-of-profit damages arising from the use of purchased products.

The Customer is required to store products properly, in a cool, dry place away from light and heat sources. Verde d’Arno shall not be liable for damage, alteration, or defects resulting from improper storage or use inconsistent with the product’s intended food use.

Art. 10 – Legal Warranty

Consumers: statutory conformity warranty pursuant to Articles 128–135-septies of the Italian Consumer Code. Defects arising within 2 years of delivery must be reported within 2 months of discovery.

Professionals: Article 1490 of the Italian Civil Code applies; defects arising within 1 year must be reported within 8 days of discovery (Article 1495 Civil Code).

Art. 11 – Right of Withdrawal

The consumer Customer may withdraw from the contract without penalty and without providing reasons within 14 days from receipt of the products.

Product(s) subject to withdrawal

IBAN and account holder for refund

Returned products must be shipped at the Customer’s expense, in perfect condition and properly packaged, within 14 days from the withdrawal notice.

Refunds shall be issued within 14 days from receipt of the returned products, net of the original shipping costs.

The right of withdrawal does not apply to:

opened or used products;

customized or made-to-order goods;

goods that are likely to deteriorate rapidly.

Art. 12 – Specific Conditions for Professionals (B2B)

Product labels supplied to professionals and resellers are available in Italian and English. The Customer is responsible for verifying compliance with local labelling and marketing regulations prior to resale.

Any customs duties, import taxes, or VAT are always borne by the Customer.

For specific VAT invoicing requests, the Customer must provide complete details before placing the order.

Art. 13 – Complaints, Applicable Law, and Jurisdiction

These Terms are governed by Italian law.

Jurisdiction for consumers: the court of the consumer’s place of residence or domicile.
Jurisdiction for B2B relationships: exclusively the Court of Florence.

Art. 14 – Severability Clause

The invalidity or unenforceability of any clause shall not affect the validity of the remaining provisions.
